1. Who we are

Gamelabs is a service for generating and managing game assets (images, animations, and spritesheets). These Terms of Service govern your use of the service. Our Privacy Policy explains how we handle your personal data.

2. Acceptance of terms

By creating an account, logging in, or using the service, you agree to these Terms of Service and our Privacy Policy. If you do not agree, you must not use the service.

3. What data we collect and why

We collect and use the minimum data needed to run Gamelabs. In plain English:

  • Account data (email, name, password hash, API key) – used to create and secure your account, authenticate you, and provide the service. Lawful basis: contract and legitimate interest.
  • Usage data (projects, assets, jobs, prompts, generation parameters, credits, timestamps) – used to generate assets, show your history, prevent abuse, and improve reliability. Lawful basis: contract and legitimate interest.
  • Billing data (purchases, subscriptions, credit ledger) – used to process payments, keep tax/audit records, and manage your plan. Lawful basis: contract and legal obligation.
  • Support and admin data (admin flags, last login, error logs) – used to operate the platform safely and help troubleshoot issues. Lawful basis: legitimate interest.
  • Analytics and tracking (page views, events) – used to understand feature usage and improve the product. Lawful basis: consent where required by law.

4. Where your data lives and how long we keep it

Your data is stored in our databases and file storage in the US West region, of our hosting and cloud providers. We keep:

  • Account, projects, assets, and jobs for as long as you have an account, until you request deletion, or as required by law.
  • Billing and purchase records for the periods required by tax and accounting laws (often 5–10 years).
  • Logs and analytics data for a limited period needed to operate and secure the service.

When you delete your account through the app, we delete or irreversibly de-identify associated account, project, asset, and job records where legally allowed. Some billing records may be retained as required by law.

5. Accounts and security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us promptly if you suspect unauthorized access.

6. Use of the service

You may use the service to generate and manage game asset content subject to these terms, applicable laws, and any usage limits in your plan. You agree not to misuse the service, including by attempting to break, overload, or reverse engineer it, or by using it for illegal content.

7. Content and intellectual property

Gamelabs owns the platform and related intellectual property. Subject to your compliance with these terms and third-party license restrictions, you retain rights to the outputs you generate. You are responsible for how you use those outputs and for complying with any applicable third-party rights and laws.

8. Commercial use

You may use the assets you generate through Gamelabs for commercial purposes, including but not limited to:

  • Incorporating assets into video games, mobile apps, or other software that you sell or distribute.
  • Using assets in commercial products, merchandise, or marketing materials.
  • Licensing or sublicensing assets as part of a larger work you create.
  • Using assets in client projects or freelance work.

There is no additional fee or royalty for commercial use of generated assets, and no attribution to Gamelabs Studio is required. However, you may not:

  • Resell, redistribute, or sublicense raw generated assets as standalone asset packs or stock resources.
  • Claim that AI-generated outputs are entirely human-created if disclosure is required by applicable law.
  • Use assets in ways that violate applicable laws, third-party rights, or these terms.

You are solely responsible for ensuring your use of generated assets complies with all applicable laws and does not infringe on third-party intellectual property rights.

9. Analytics, tracking, and "Do Not Sell/Share"

We may use analytics and similar tools (for example, event and page view tracking) to understand how the service is used and to improve it. Under laws like the CCPA/CPRA, this can be treated as "sharing" personal information for "cross-context behavioral advertising."

If you are a California resident, you have the right to opt out of this type of "sale" or "sharing." We provide a Do Not Sell or Share My Personal Information control on the Privacy page where you can change this preference at any time. We honor your selection going forward.

10. Your rights over your data

Depending on where you live (for example, under GDPR, UK GDPR, or CCPA/CPRA), you may have rights to:

  • Access a copy of your personal data.
  • Correct inaccurate or incomplete data.
  • Export your data in a portable format.
  • Delete your data, subject to legal retention requirements.
  • Object to or restrict certain processing.
  • Withdraw consent where processing is based on consent.

You can exercise key rights directly in the app by using the data export and account deletion tools on your profile page. You can also contact us using the details below for other requests.

11. Pricing and service changes

Our pricing, credit bundles, free tiers, and feature set may change over time. We may add, remove, or modify features, impose or adjust usage limits, or discontinue parts of the service. When we make material changes to plans or pricing that affect your existing subscription or purchased credits, we will make a reasonable effort to notify you in advance (for example, by email or in-app notice) and apply changes prospectively.

12. Rewards and referral program

Gamelabs offers a rewards program that lets you earn free credits by referring new users or sharing about the platform on social media, blogs, or video platforms. By participating, you agree to the following:

  • Credits are non-transferable and have no cash value. Reward credits may only be used toward asset generation on Gamelabs and cannot be redeemed, exchanged, or refunded for money.
  • Honest participation. Submissions (URLs to posts, videos, or articles) must be genuine, publicly accessible, and created by you. Sharing content that is misleading, spam, or artificially generated solely to claim credits is prohibited.
  • Admin review. All share submissions are subject to review and approval by Gamelabs. We may approve, reject, or request changes to any submission at our discretion.
  • Referral integrity. Referral credits are earned when a new user signs up using your unique referral link and, separately, when that user makes their first purchase. Self-referrals, fake accounts, or any scheme to artificially inflate referrals is prohibited.
  • Limits. Sharing rewards are limited to one submission per share type per platform per user. Referral credit amounts and tier thresholds may change at any time.
  • Abuse and revocation. We reserve the right to revoke credits, disqualify submissions, reset tiers, or suspend your account if we determine, at our sole discretion, that you have violated these rules or engaged in abusive behavior.
  • Program changes. We may modify, suspend, or discontinue the rewards program at any time without prior notice. Earned and approved credits already in your account balance will not be affected by program changes.

13. Termination

We may suspend or terminate your access if you violate these terms, misuse the service, or if we are required to do so by law. You may stop using the service and delete your account at any time from your profile page.

14. Disclaimers

The service is provided "as is" and "as available," without warranties of any kind. We do not promise that outputs will be free from infringement, suitable for a particular purpose, or error-free, and you use them at your own risk.

15. Limitation of liability

To the maximum extent permitted by law, Gamelabs Studio and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or business opportunities, arising out of or related to your use of the service.

16. Changes to these terms

We may update these terms from time to time. If we make material changes, we will post the updated terms here and update the "Last updated" date. If changes are material, we may also notify you by email or in-app notice.
